In Brief - Data Protection

The Office of the Information Commissioner has published a consolidated version of the guidance on data protection issues in employment. This brings together the four existing guides on recruitment and selection, employee records, monitoring at work and medical information and is intended to provide employers with a complete manual on data protection in the workplace.

Technical guidance which deals with the potential conflict between an individual’s right of access to information held about themselves and another individual’s right to privacy or confidentiality is also available. This sets out the main factors you need to consider if you receive a subject access request which involves information relating to other individuals as well as the person making the request.
