Whistleblowing

The term whistleblowing applies where an employee discloses acts of their employer that are either unsafe or illegal. If you are in the position of being a whistleblower, you need strong and early legal advice to protect your position.

When Can You Whistleblow?

The Public Interest Disclosure Act 1998 sets out the circumstances where the employee can make a protected disclosure if they have a reasonable belief that they have been committed. They are:

  • A criminal offence
  • Acts causing environmental damage
  • Health and safety issues
  • Miscarriages of justice
  • Failure to comply with a legal duty
  • Covering up any of the above acts
