Our Civil Litigation and Dispute Resolution Experience
At Kingsley Smith Solicitors we have years of experience in dealing with dispute resolution. Our expert civil litigation team are friendly, and supportive.
We will take the time to listen to the background and circumstances surrounding the dispute and use our knowledge to determine the most effective path to resolve the problem.
We can help with the following situations:
- Contract disputes (employment and others)
- Whether with employers or colleagues
- Claims on the estate of someone who has passed away
- Professional negligence
- Conflicts with retailers, charities, suppliers or service providers
- Trust disputes
- Consumer issues including consumer credit act issues
- Where you are having problems repaying debts
- Neighbour disputes
- Issues with trees, shrubs, foliage
- Boundary and property disagreements
- Claims against garages/car dealers for the selling of 'defective' vehicles
- Bringing or defending a building claim for outstanding monies and/or defective workmanship
We understand that being threatened by legal action can be a daunting and worrying prospect. You may also be concerned about the costs of taking or defending legal action.
A quick dispute settlement is important, as a delay can result in additional costs and an unnecessary escalation of conflict.
It’s always recommended to resolve these sorts of issues as quickly as possible, to increase the likelihood of a satisfactory resolution for all parties. We can help you to achieve this.
Wherever possible, we seek to settle disputes by amicable negotiation. In many cases, disputes can be resolved by using alternative dispute resolution (ADR) methods including mediation, arbitration and round table meetings. These are non-binding processes involving an impartial third party, who through an informal process helps to bring about a settlement to the conflict.
These ‘round table discussions’ tend to be more informal and less adversarial than going to Court, saving you money and time. Our civil litigation team will work for you to reach a mutually satisfactory outcome for both parties.
There are points during the dispute resolution process when court action may be needed. Our litigation team will provide a robust and efficient presentation of your case in order to gain the best result.
What are Small Claims?
All legal claims with a monetary value of £10,000 or less (with the exception of personal injury claims) are treated as Small Claims at the county court.*With the exception of Personal Injury Claims. In most cases, legal costs are not recovered with a small claim. You may therefore find that your legal costs could outweigh the value of your claim.
Our team at Kingsley Smith Solicitors understand you may not wish to use our services from the start to the end of your claim. With this in mind, we offer a practical fixed fee service, allowing you to use our expertise only when you need it.
For example you may need someone to represent you at a hearing, or to draft the Particulars of the Claim or Defense. To find out more about how we’ve helped people in the past, we refer you to our client testimonials.
These are normally for claims with a monetary value of between £10,001 to £25,000 and which can be disposed of by a trial which will not exceed a day. These are normally dealt with at the County Court.
These types of claim are those that exceed a monetary value of £25,001 and are normally intended for more complex and important cases.
We aim to provide a high quality litigations service and will deal with your matter in a friendly and professional manner. We also work hard to ensure that there is regular communication keeping you informed about the progress of your case.
