The Dispute Resolution Procedure

Wherever possible, we seek to settle disputes by amicable negotiation. In many cases, disputes can be resolved by using alternative dispute resolution (ADR) methods including mediation, arbitration and round table meetings.  These are non-binding processes involving an impartial third party, who through an informal process helps to bring about a settlement to the conflict.

These ‘round table discussions’ tend to be more informal and less adversarial than going to Court, saving you money and time. Our civil litigation team will work for you to reach a mutually satisfactory outcome for both parties.

There are points during the dispute resolution process when court action may be needed. Our litigation team will provide a robust and efficient presentation of your case in order to gain the best result.

Types of Claim

When it comes to litigation disputes there are three main types of claims, within the County Court namely: Small Claims, Fast-Track Claims and Multi-Track Claims.

What are Small Claims?

All legal claims with a monetary value of £10,000 or less (with the exception of personal injury claims) are treated as Small Claims at the county court.*With the exception of Personal Injury Claims. In most cases, legal costs are not recovered with a small claim. You may therefore find that your legal costs could outweigh the value of your claim.

Other Claims

Fast Track:
These are normally for claims with a monetary value of between £10,001 to £25,000 and which can be disposed of by a trial which will not exceed a day. These are normally dealt with at the County Court.

Multi Track:
These types of claim are those that exceed a monetary value of £25,001 and are normally intended for more complex and important cases.
