Problems with new builds
If you’ve recently purchased a new build property and are experiencing structural problems, we can help you resolve these issues as quickly as possible so that you can start enjoying your new home.
Having purchased a new build, you expect the finish to be flawless and you certainly don’t expect to encounter structural problems. If you’ve discovered defects in the foundations like subsidence, uncovered issues with damaged walls and floors, or simply feel the overall workmanship standards are poor, then you can take action.
As a new home owner, you should be protected by a new build warranty. This is covered by the NHBC - the UK’s leading new home warranty provider. During the first two years of the NHBC scheme, the builder is responsible for putting right any damage caused by their failure to build in accordance with NHBC standards. After that period, and within the first 10 years only, the policy tends to only cover major defects. In all cases, you will have a contract with the builder or developer, in which they are responsible for building to the terms set out in the contract.
At Kingsley Smith Solicitors, our Dispute Resolution Team will work tirelessly towards achieving what was stated in the original contract. We will also look at the details within the NHBC warranty and give helpful advice on the best course of action.
We will undertake building dispute resolution, mediating between you and the person or company with whom your contract is with. At Kingsley Smith Solicitors, our team is friendly and approachable. Make an online enquiry, call us on 01634 811118 or drop us an email at: email@example.com.
If you’re going through a building contract dispute, it can be complex, stressful as well as costly. At Kingsley Smith Solicitors, we will do our upmost to ease the dispute with our expert conflict resolution processes.
If you’ve experienced defective work from a builder, or have been left with an unfinished project, we will work quickly to assess the situation. We will firstly find out if the builder is insured and still trading.
Secondly, we will work with both parties to choose an impartial surveyor to examine the work done. They will advise if the original contract, whether written or verbal, was fulfilled to either party's expectations. We would ensure that the costs of this survey were split between both the builder and client.
Kingsley Smith Solicitors work hard to reach an agreement with the builder that avoids taking the case to court, saving you money in the long-run.
